Service Agreements
All services are subject to a separate Service Agreement that outlines specific terms, pricing, and conditions. The Service Agreement takes precedence over these general Terms and Conditions in case of conflict.
Payment Terms
- Payment is due according to the terms specified in your Service Agreement
- Late payments may be subject to fees as outlined in your agreement
- We accept major credit cards and electronic payments through our secure payment portal
- Returned payments may incur additional fees
Monitoring Services
Our 24/7 monitoring services include:
- Alarm signal monitoring and response
- Emergency dispatch coordination with local authorities
- System status monitoring
- Customer notification of alarm events
Response times may vary based on system performance, signal transmission, and local emergency services availability.
Equipment
Equipment provided under a Service Agreement remains the property of Berkley Security Inc. unless otherwise specified in writing. You are responsible for maintaining and protecting the equipment from damage or theft.
Warranties
Equipment warranties are provided as specified in your Service Agreement. We make no warranties beyond those explicitly stated. Implied warranties of merchantability or fitness for a particular purpose are excluded.
Limitation of Liability
Berkley Security Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or equipment. Our total liability shall not exceed the amount paid by the customer in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Berkley Security Inc. from any claims, damages, or expenses arising from your use of our services or violation of these Terms and Conditions.
Termination
Either party may terminate services according to the terms specified in the Service Agreement. Early termination fees may apply as outlined in your agreement.
Governing Law
These Terms and Conditions are governed by the laws of the State of Mississippi. Any disputes shall be resolved in the courts of Mississippi.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
